Terms and Conditions (T&C)

§ 1 Scope of Application

These General Terms and Conditions apply to all contracts concluded between Argesteel, Inh. Olena Hil (hereinafter "Seller"), Saarstraße 21 DE, 38440 Wolfsburg, and the customer (hereinafter "Buyer") via the online shop at https://www.argesteel.com.

Deviating conditions of the Buyer are not recognised, unless the Seller expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the "Order with obligation to pay" button, the Buyer submits a binding offer to purchase. Acceptance of the offer takes place through a separate order confirmation by e-mail or by dispatch of the goods.

The contract text is stored by the Seller and is accessible to the Buyer upon request after conclusion of the contract.

§ 3 Prices and Payment Terms

All prices stated are final prices in Euro (€). Since we do not charge VAT as a small business according to § 19 UStG, the prices do not include VAT. Additional delivery and shipping costs are shown separately in the order process.

Payment is due immediately upon order. The following payment methods are accepted:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Apple Pay / Google Pay
  • Other methods displayed at checkout

§ 4 Delivery and Shipping

Delivery is made to the delivery address specified by the Buyer. Delivery times are indicated on the respective product page and in the order process. Unless otherwise specified, the standard delivery time is 7–21 working days (international delivery).

We ship from various warehouses. It is possible that items from an order may be delivered in multiple packages.

Shipping costs are displayed at checkout. Free shipping may be offered for orders above a certain value – the applicable conditions can be found in the shop.

§ 5 Retention of Title

The delivered goods remain the property of the Seller until full payment of the purchase price.

§ 6 Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. Details can be found in the separate withdrawal policy, which is part of these T&C and can be accessed at https://www.argesteel.com/policies/refund-policy.

Exclusion of the right of withdrawal: The right of withdrawal does not apply to goods that are manufactured according to customer specifications or are clearly tailored to personal needs (§ 312g para. 2 no. 1 BGB). This applies in particular to personalised and engraved jewellery.

§ 7 Warranty

The statutory warranty rights apply. The warranty period for new goods is two years from delivery.

§ 8 Product Description and Jewellery Notice

All jewellery in our shop is gold-plated or silver-plated fashion jewellery (18K gold-plated, silver-plated or similar). It is not solid gold or silver jewellery. The base material is usually copper, brass or S925 Sterling Silver, as indicated in the respective product description.

Product images may show colour deviations, which can be caused by screen calibration. These do not constitute a warranty claim.

§ 9 Limitation of Liability

The Seller is liable without limitation for intent and gross negligence. For slight negligence, the Seller is only liable for the breach of essential contractual obligations (cardinal obligations), for damages resulting from injury to life, body or health, and for fraudulent concealment of a defect.

§ 11 Dispute Resolution

The European Commission no longer provides an online dispute resolution platform (the ODR platform was discontinued on July 20, 2025).

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

§ 12 Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the Buyer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Wolfsburg. Otherwise, the statutory places of jurisdiction apply.

For consumers within the EU, they can also claim the consumer protection provisions of their country of residence.

§ 13 Final Provisions

Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the statutory provision.
